After the Chief Legal Counsel (CLC) of a Fortune 500 casino and entertainment corporation confirmed through a proof of concept (POC) that Text IQ’s AI solution could successfully automate first pass privilege review, he decided to expand the role of Text IQ in the company’s document review workflow beyond privilege review. He decided that if Text IQ’s AI could handle privilege review, one of the most complex and important stages of litigation, then it could surely handle substantive responsiveness review.
Substantive responsiveness review is the process of deciding what documents are relevant to a litigation and must therefore be produced. This is the first step in reviewing documents for litigation. Manually reviewing documents is time consuming, expensive, and subject to human error. The sheer volume of data means that a manual review can take months and require thousands of attorney hours. As Paul Noonan, eDiscovery Counsel at United Airlines, explained that, “Contract attorneys are highly imperfect. They are pushed very hard and they are prone to mistakes.”

Text IQ was able to quickly remove nearly 50% of the document population as non-responsive - in other words, approximately 150,000 documents no longer required review. This resulted in a cost savings of approximately $200,000 just on the responsive review automation. When combined with the privilege review automation, this amounted to a total savings of about $300,000. It also indicated that the Fortune 500 company could now automate its entire first pass document review without risking a loss of accuracy. This would result in an estimated one million dollars per year in bottom line cost savings, in addition to the faster turnaround times, improved accuracy, and improved consistency.
The workflow improvements that Text IQ provided became strikingly clear when the CLC was faced with a seemingly impossible deadline. As he described, “In one particular matter, I only got the discovery request 30 days before our actual production was due. Because of the challenges with outside counsel and our legal services provider, we were not going to be able to meet those deadlines. Finally, the days of paying to have the same document reviewed multiple times were over, and over time, the Text IQ “AI Brain” would continue to learn and understand the organization better, resulting in even greater efficiencies the more it is used.
